SWEEET REPEEET CONSIGNMENT AGREEMENT

Overview

This is a preview of the contract between Sweeet Repeeet Consignment and the undersigned (consignor). By signing, the party agrees to the full terms and conditions of this contract. 

Commission: 

40/60% split:

  • The consignor will receive a 40% commission of all sold items (items individually priced under $600) within a 70 day period. The consignor’s earnings will be kept in their account for them to use as store-credit or take in the form of a check.

50/50% split:

  • The consignor will receive 50% commission of all sold items within a 70 day period. The consignor’s earnings will be kept in their account for them to use as store credit only

60/40% split:

  • The consignor will receive 60% commission of sold individual items each priced over $600. The consignor’s earnings will be kept in their account for them to use as store creditor take in the form of a check.

Consignment Period: 

  • “Standard” items (items priced less than $130) will be available to purchase for a period of 70 days.
  • The 70 day period begins the day the consignor receives their emailed itemized list of accepted apparel. After such time any unsold items exceeding the 70 days will become the sole property of Sweeet Repeeet Consignment, unless the consignor has indicated on their Item Intake Form that they wish to pickup specific or all unsold items.
  • High-end items (items individually priced above $130) will remain for sale past the 70 day period. These items will remain the property of the consignor until an extended but reasonable time has ensued (4 months past the 70 days selling period) in addition to there having been no communication from the consignor; at which point Sweeet Repeeet Consignment has full discretion to claim ownership of the item(s) upon point of sale.
    • Note: Sweeet Repeeet Consignment does not donate high-end items even past the 70 day selling period if unsold, unless the item is flawed or unsellable, at which point staff will attempt to contact the consignor for pickup. 

“Drop & Dash” Item Drop-Off & Donation 

  • New consignors must make an appointment to consign.
  • Established consignors who have accounts are encouraged to “Drop & Dash” their items–dropping off their items between the days of Tuesday – Thursday and between the times of 11:00 – 3:00.
  • At any point after dropping off their items, the consignor gives Sweeet Repeeet staff full authority to donate or discard any items not accepted by staff to resell. 
  • Exception: If after the initial drop-off there are items not accepted by Sweeet Repeeet staff that the consignor wishes to take back, the consignor must communicate with staff which items they will collect before leaving their drop-off and collect within 7 business days; otherwise Sweeet Repeeet staff has full authority to donate or discard unwanted items.
  • If any accepted “non-donate” item becomes unsellable (i.e. flaws are found after the initial drop off), Sweeet Repeeet staff will email the consignor to pick up the item. If the item is not picked up within 7 business days of the email notification, Sweeet Repeeet staff has full authority to donate or discard the item.

Unsold Item Pick-Up: 

  • If there are “standard” items the consignor wants back if unsold, they must indicate which items on the “Item Intake Form” at the time of drop off and collect the items before the 70 day expiration date, or communicate with management for an extension.

Unclaimed Cash

  • Earnings in the consignor’s account must be claimed within 1 year from the consignment sold date. Unclaimed earnings will be voided with no further liability on the part of Sweeet Repeeet to pay out the balance.
  • All issued checks must be cashed within 6 months or 183 days of the pay date or they will be voided.

Promotions

  • All store merchandise is subject to promotions without notice to the consignor at the discretion of management.

Pricing

  • All items accepted by Sweeet Repeeet Consignment are priced to be competitive with similar markets, such as Depop, Poshmark, The Real Real, ThreadUp, Ebay and others, as well as seasonal changes.
  • At the initial drop-off of items, Sweeet Repeeet staff is not subject to provide the consignor exact prices of accepted items. 
  • If the consignor is unsatisfied with the initial listed price of an item shown on their emailed item list, it is the consignor’s responsibility to communicate with Sweeet Repeeet management to adjust the price or pick up the item in question. 

Lost, Stolen, Damaged Items

  • Sweeet Repeeet Consignment is not responsible for items that have become lost, stolen or damaged while on the selling floor.

Liability Disclaimer: This contract limits Sweeet Repeeet Consignment and its employees from all liability. The signing party will hold Sweeet Repeeet Consignment, its owner, and employees harmless from any dispute or legal action.
